TERMS OF SERVICE

1. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for any content you upload and for ensuring you have the necessary consent from all participants before recording a session. All participants in a voice channel should be aware that recording is taking place when Kazkar is active.

2. User Accounts

You are responsible for safeguarding your account information. Access to Kazkar is provided through Discord OAuth. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Recording Hours

Your account includes a set number of recording hours. Usage is tracked per session. Unused hours do not roll over between billing periods. We reserve the right to modify hour allocations with reasonable notice.

4. Content Ownership

You retain ownership of all content associated with your sessions, including audio files and generated chronicles. We do not claim any ownership rights to your content. We require a limited license to your content solely to operate and provide the Service — specifically, to process audio, generate transcriptions, and create narrative chronicles.

5. User Content & Public Sharing

You are solely responsible for all content generated through your use of the Service, including chronicles, transcriptions, and any content you choose to share publicly. By making any content publicly accessible, you represent and warrant that:

• You have the right and consent of all participants to share the content.
• The content does not contain material that is defamatory, obscene, threatening, harassing, or otherwise objectionable.
• You accept full responsibility for any consequences arising from sharing the content, including any claims by third parties.

Kazkar.ai does not review, endorse, or assume liability for user-generated content. Publicly shared content may contain mature themes, including but not limited to violence, strong language, or other adult content typical of tabletop roleplaying games. Kazkar.ai is not responsible for any content shared by users and reserves the right to remove any content that violates these Terms without notice.

6. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. You control whether audio recordings and transcriptions are retained after processing through your campaign privacy settings.

7. Acceptable Use

You agree not to:

• Record individuals without their knowledge or consent.
• Use the Service to process content that is illegal, harmful, or violates the rights of others.
• Publicly share content that contains real personal information of other participants without their explicit consent.
• Use the Service to generate, store, or distribute content depicting illegal activity, non-consensual acts, or exploitation of minors.
• Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
• Resell, redistribute, or sublicense access to the Service without our written permission.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

9. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation or availability of the Service, or the accuracy, reliability, or completeness of generated chronicles. Chronicle generation relies on AI processing and may not perfectly capture every detail of your session.

10. Limitation of Liability

In no event shall Kazkar.ai, nor its creators, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the updated Terms of Service on this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
